The Sr.Inspector,
Khar Police Station
Mumbai-52

Sir,

I had been arrested by your police station on 28/03/05 on a baseless complaint filed by
PSI Mehboob Inamdar of EOW, stating that I had broken a court seal of flat no 501, 502, Pinky
Panorama, 6th Road, Khar (w), on 27th Feb ‘05. Ref case no: 103/05.

PSI M. Inamdar had stated in his FIR, that he had sealed the flat on 8th Feb ’05. I had
explained to the investigating officer, API Arun Walzade, Sr. Inspector Satish Shingte and
PSI M. Inamdar, that various officers of Bharat Overseas Bank and Punjab National Bank had
opened the flat and shown it to various potential buyers on the 11th & 12th Feb ’05. I had also
given them an extract from the register maintained by the society, which clearly indicated the
names of the bank officers and had their signatures. This clearly indicated that the bank
officers on 11th & 12th Feb ‘05 had removed the seal if any was there. All this was ignored by
the above mentioned officers.

The most important aspect is that the register also indicated that the investigating officer,
API  Arun Walzade had also visited the building on 14/02/05 and was well aware of the bank
officers having opened the flats on 11th & 12th Feb ’05.

Yet, I was arrested. My wife and son applied for anticipatory bail.
On 29th March I was remanded to police custody till 31st March by  Bandra (E) court. The
investigating officer extracted Rs.50,000 from my family to facilitate my release on bail on 31st
March ’05.

On 31st March ’05, I was further remanded to police custody till 2nd April ’05. Hearing this my
wife was disconsolate and desperately sought out API Walzade who had taken Rs.50,000/-.
API Walzade called my wife to Bandra police stn. where I was lodged. My wife had brought
food and clothes, he did not allow those to be given to me.

He let her speak to me only through the door bars for 2-3 minutes. After that he took her aside
and suggested she surrender to him saying, “Mera haath pakdoge to sukhi rahoge”, he will
take care of everything, no need to seek anticipatory bail. While saying all this he tried to grab
her hand. He further told her that  “your husband will remain in jail for another 6 months atleast,
since it is an MPID matter”

I was released on bail on 2nd April ’05. My wife has been hysterical every night ever since. Any
noise she heard of a car being parked below the building, provoked her into crying fits saying
that, “Walzade has come to take you to jail again.”

We have finally taken her to a Psychiatrist, Dr. Harish Shetty on 12th April ’05. She is now
under his treatment.

It is my plea that appropriate action be taken against all the officers responsible for putting me
in jail and subsequent harassment of my wife.

Sincerely

I K Chhugani

(After my wife and son were granted anticipitary bail on 15/4/05, I approached Sr PI SatishShingte and ACP Vijay Mahajan, and demanded to know, "On what basis you people  had arrested me". I also demanded Rs 50,000/- back, the amount extracted by API Walzade from my family. Both never denied, extraction of Rs 50,000/-. I even told them "I do not even want to know, with whom he has shared all the money". On Saturday 23/4/05 I gave them the deadline of 5 pm.
By 6 pm when I had not received the money back, I filed the above  written complaint.
Which they accepted after a lot of wrangling.)
