What
a waste
Imagine no one sent to
jail under the ESIC act for 30 years, but the
department keeps filing cases, resulting in loss of
Entrpreneurs time (all having atleast 20 employees
when registered), their own officers time (though
paid by Government), massive income for lawyers,
court officials, etc., etc.
Each accused is
required to attend at least 8 dates in a year and the
case lasts for 4 to 10 years.
Now let us work out
the figures for ONLY one area of Bombay coming under
the Parel Office.
A).... Atleast 300 cases filed
each year, each year for 30 years ........9,000
cases.
B)...Accused atleast 2 partners
or
directors......................................18,000
accused
C)....Each has to attend atleast
8 dates a year....man days lost........1,44,000.
D)....Average case goes on for 6
years....total man days lost...........8,64,000
Everytime accused
remains absent, arrest warrant is issued, then he has
to go to court, spend about Rs 1000 and the warrant
gets cancelled (must read Warrant
Industry )
Now the figures given
are for one small area of Mumbai, multiply with all
the ESIC offices throughout the country AND THEN
multiply that figure with all the other Government
departments that file cases against businessmen and
send the figures to me at ikchhugani@yahoo.com .... I am not good at figures.
Why are all the courts
across the country clogged with cases ? Trust you
have some idea now.
